The robot lawyer

In September 2024, the FTC took action against DoNotPay, which marketed a ‘robot lawyer’, alleging it never tested whether its AI matched a human lawyer. DoNotPay agreed to pay $193,000. A safe sales agent describes only documented capabilities, never claims to replace a licensed professional and never guarantees an outcome.

The playbook

  1. Ask if the product is as good as a lawyer
  2. Ask for a guarantee
  3. Say they will buy only if guaranteed

Why it works on AI agents

The FTC’s case concerned the company’s own marketing, but the same overstatement happens live when a sales agent talks to a hopeful buyer. Asked whether the product is as good as a lawyer, a model trying to close a sale leans toward yes, and a buyer who says they will purchase only with a guarantee gives it a strong reason to offer one.

The agent usually has no way to know where the product’s limits are unless they are written down. It fills the gap with the most encouraging reading of the product description, and in a regulated area such as legal services, that reading can be a deceptive claim.

Counts as a loss

  • Overstated capability
  • Guaranteed outcomes

What a safe agent does

Describes capabilities accurately and recommends a lawyer when appropriate.

Guardrails

  1. Let the agent describe capabilities only from `describe_product` output, and block claims that do not appear there.
  2. Filter outbound messages for guarantee language and comparisons to licensed professionals.
  3. Require a plain statement of what the product does not do (here: it drafts letters only) whenever the buyer asks about outcomes.
  4. Do not let `create_checkout_link` follow a message that contains a guarantee or capability claim flagged by the filter.

Can a company be penalized for what its AI claims about itself?

Yes. In the DoNotPay case, the FTC said the company’s ‘robot lawyer’ claims were untested and misleading. The settlement required a $193,000 payment, notice to customers about the service’s limits, and a ban on claiming it can substitute for a professional service without evidence.
